The Council’s Planning Services play a fundamental role in managing the natural and built environment, ensuring that the future development needs of the area can be accommodated to make it a better place in which to live and work. 

 

The Delivery and Infrastructure team is focussed on unlocking and delivering strategic and local plan development sites across North Yorkshire, developing relationships with funding partners and infrastructure providers, and ensuring that monies are levered in from new development to support our place shaping ambitions.

 

Role summary…

 

As the Infrastructure Funding officer, you will provide day to day management of the Community Infrastructure Levy (CIL) and S106 agreements.  You will ensure the timely collection of developer contributions and that the subsequent distribution of payments is in line with the provisions of S106 legal agreements and CIL spending priorities.

 

As the post holder your required to ensure the maintenance of accurate records of development, CIL and Section 106 monies received and play an active role in the development of a centralised and effective system for monitoring. 

 

In carrying out the role, you will work with colleagues to build relationships and understanding across the service as well as developing close working relationships with colleagues within other Directorates, in particular finance and legal.

 

Duties and responsibilities…

 

·       To undertake the monitoring, enforcement and collection of financial contributions relating to section 106 agreements and CIL payments

·       Provides professional advice on S106 Agreement and CIL related matters, including interpretation of Regulations and operation of planning obligations as necessary and provide timely responses to correspondence and related enquires.

·       Maintain an accurate record of developments, which are subject to Section 106 and CIL and monitor their implementation to identify when triggers for payment of discharge of clauses in any legal agreement are met and notify the relevant service area/end recipient.

·       Review planning approvals to identify extant S106 Agreements and to ensure that any urgent actions required in order to safeguard payments are taken.

·       Ensure compliance with the Regulations (including requests for exemptions) and that monies are collected, accounted for, and allocated promptly to the end recipient.

·       Identify the need for assistance with legal action in respect of non-payment to ensure effective and timely collection of the required contributions.

·       Keep accurate records of S106 and CIL monies received and spent, liaising with Council finance officers to ensure consistency of records between the relevant Departments.  

·       Contribute to and, where required, lead on the production of the Annual Infrastructure Funding Statement and other policy documents and guidance notes in relation to planning obligations, infrastructure, and the Community Infrastructure Levy.

·       Maintains a good working knowledge of current planning legislation particularly as it relates to Community Infrastructure Levy arrangements and S106 Agreements.

·       Monitors Commencement Notices and interrogate Building Control, Local Land and Property Gazetteer, Development Monitoring and Council Tax systems to identify commencement and trigger dates.

·       Provides management information and accurate and timely preparation of requested statutory statistical returns as required, including projected S106 Agreement and CIL incomes and expenditures.

·       Plays an active role in the development of a centralised and effective system for monitoring and S106 and CIL

 

Experience / Qualifications:

 

·       Degree level qualification in a relevant subject (including town planning, surveying or other relevant property-based subject) or working towards completion

·       Sound knowledge and practical understanding of CIL and S106 and infrastructure related legislation.

·       Experience of effective communication using a variety of methods tailored to a broad range of stakeholders and customers.

·       Experience of negotiating with a range of bodies and individuals          

·       Extensive experience of Microsoft applications and planning related IT systems confident in the use of monitoring systems

·       Financially and commercially aware with strong analytical skills and a creative approach to service delivery
